TRIATHY 2027 – TERMS AND CONDITIONS OF ENTRY AND PARTICIPANT WAIVER

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE SUBMITTING YOUR ENTRY.
By submitting this entry application and making payment, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions of Entry and Participant Waiver in full. Acceptance will be recorded electronically together with the version number, full text accepted, and timestamp. These Terms constitute a legally binding agreement between you (the "Participant") and TriAthy Ltd ("the Organisers", "TriAthy", "we" or "us").
1. Acceptance of Entry and Assumption of Risk
In consideration of the acceptance of this entry, I agree that I enter TriAthy 2027 (also referred to as "the Event") at my own risk. To the fullest extent permitted by Irish law, no person(s) or organisation(s) will be held responsible for any expense, accident, injury, illness, loss or damage to myself, my property, my family or dependents, sustained prior to, during or after the Event, or arising directly or indirectly from my participation.
I am aware of and voluntarily assume all inherent and significant risks associated with participating in the Event. These risks include, but are not limited to: falls, trips, collisions or contact with other participants, spectators, officials, vehicles, equipment or objects; effects of weather (including extreme heat, cold, wind, rain, lightning or poor visibility); traffic and conditions on public roads or closed courses (including other road users, road surface defects, mechanical failure, or loss of control); open-water and river conditions during the swim leg (including water temperature, currents, visibility, submerged hazards, marine life, drowning risk, hypothermia, or collision with other swimmers, craft or buoys); the physical demands of swimming, cycling and running in a mass-participation triathlon, including fatigue, dehydration, cramp, cardiac events or other medical incidents; actions or inactions of other participants, spectators, volunteers, officials or third parties; and any other risks inherent in the sport of triathlon or in the organisation and conduct of a mass-participation event.
I understand that this waiver and assumption of risk includes any claims arising from negligence, the action or inaction of any of the Released Parties (defined below), or otherwise. I acknowledge that none of the Released Parties shall be liable for the actions of spectators or other third parties.
2. Fitness to Participate, Medical Declaration and Emergency Consent
I understand that participating in this Event is physically demanding and potentially hazardous. I confirm that I am physically and medically fit, properly trained, and able to participate safely. I have no physical, medical or mental disabilities, impairments, conditions or injuries which would endanger myself or others taking part, or which I have not disclosed to the Organisers. I have consulted a medical professional where appropriate and accept full responsibility for my decision to participate.
I hereby consent to TriAthy Ltd, its medical providers, volunteers, officials, agents and any attending medical personnel providing or arranging such emergency medical treatment, first aid, medication, transportation to hospital or other care as may reasonably be necessary in the event of injury, illness or medical emergency during or in connection with the Event. I authorise the release of relevant medical or personal information to such personnel for treatment purposes and waive any claim arising from such treatment or transportation to the fullest extent permitted by law.
3. Release, Waiver and Limitation of Liability
In consideration of being permitted to participate, I, for myself, my heirs, executors, administrators, successors and assigns, hereby expressly waive, release, discharge and forever hold harmless Triathlon Ireland, TriAthy Ltd, their officers, directors, employees, volunteers, agents, sponsors, event officials, landowners, local authorities and all other Released Parties from any and all liability, claims, demands, actions, causes of action, costs or expenses (including legal fees) whatsoever arising out of or in any way connected with my participation in the Event, whether caused by negligence or otherwise.
This release applies to any pain and suffering, injury, illness, death, loss or damage to person or property, whether sustained in, arising from, or indirectly connected with the Event. I understand that this waiver includes claims arising from the negligence, action or inaction of any Released Party, to the fullest extent permitted by Irish law. Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence or wilful misconduct of the Released Parties, or for any other liability that cannot be excluded or limited under applicable Irish law (including the Unfair Terms in Consumer Contracts Regulations).
4. Compliance with Rules and Race Licence
By submitting this application I agree to and will abide by the rules of Triathlon Ireland and of the Event. It is my responsibility to consult the Event website www.triathy.com for the most up-to-date version of the rules. TriAthy 2027 is a Triathlon Ireland sanctioned event, and I understand that I am required to hold a valid Triathlon Ireland Race Licence in order to participate. I am responsible for obtaining my own licence directly from Triathlon Ireland — either an annual membership or a One Day Membership Licence — and I acknowledge that TriAthy does not sell, provide, or confer any Triathlon Ireland licence or membership as part of this entry. I must provide the race organisers with my Triathlon Ireland membership number, or evidence of my One Day Membership Licence, in order to be admitted to participate on race day.
5. Event Changes, Refunds, Cancellation and Postponement
The Organisers reserve the right to alter the arrangements and conditions of entry should circumstances require, and to change the date of the Event.
If I withdraw from the Event on or before 1st February 2027, I shall be entitled to a refund of my entry fee, subject to an administration fee of up to €10. Notice of withdrawal must be received by TriAthy Ltd in writing on or before that date. After 1st February 2027, the maximum refund will be 75% of the entry fee before 31st March 2027, reducing to 50% before 30th April 2027. After 1st May 2027 all entries are final and no refunds will be made.
The Organiser shall not be responsible for postponement or cancellation of the Event resulting from causes beyond their reasonable control, including but not limited to: government action; crisis; acts of God; strikes or other labour disturbances; equipment failure; inability to obtain supplies; acts of terrorism; floods; fires; accidents or any other circumstance beyond the control of the Organisers. In such an event, the Organiser reserves the right to reschedule the Event to a future date. In this instance, I agree that no refund will be made and my entry will transfer to the rescheduled Event date. Should a change of date happen and I am unable to attend on the revised date, the Organisers may, at their sole discretion, permit my entry to be transferred to another participant or deferred to a future TriAthy event.
6. Removal, Disqualification and Safety
The Organisers reserve the right at any time to remove participants from the Event or to prevent participants taking part, if in the Organisers' sole discretion it considers such action necessary for safety reasons, the proper enjoyment of the Event by other participants, or for any other reasonable reason. No refund shall be made where a participant is disqualified as a result of an infringement of these Terms and Conditions, or where a participant has acted with wilful misconduct or otherwise without due care and attention.
7. Image Rights and Intellectual Property
I hereby grant full permission to TriAthy Ltd and all Released Parties to use and reproduce any images or recordings whatsoever, fixed or moving, taken of me at this Event for any legitimate purpose, including but not limited to the advertising, promotion or exploitation of the Event (and future events) through television, film, video, digital media, social media or any other medium. This permission is unlimited in time, territory and medium.
I confirm that all intellectual property in connection with any such images or recordings shall remain the property of TriAthy Ltd. Where such intellectual property does not automatically vest in TriAthy Ltd, these Terms and Conditions shall constitute a legally binding assignment thereof, and I consent to the signing of all reasonable documentation required to give effect thereto.
8. Personal Information and Data Protection
I consent to TriAthy Ltd holding and using all personal information disclosed by me, or on my behalf, in conjunction with my participation in the Event. I agree that TriAthy Ltd may use my personal information to contact me, to publish race results and reports, and to share my data with third parties associated with the race (including timing companies, Triathlon Ireland, medical providers and insurers), in accordance with the Event's Privacy Notice (available at www.triathy.com/privacy). I understand my data protection rights, including rights of access, rectification, erasure and objection, as further detailed in the Privacy Notice.
8a. Published lists and results
By entering, you acknowledge and agree that your name, club and race category will be published on the event entrants list, start lists, live tracking and results, before, during and after the event. Requests for suppression from pre-race lists in exceptional circumstances may be made to info@triathy.com.
9. Severability, Governing Law and Dispute Resolution
To the extent permitted by law, all provisions of these Terms and Conditions shall be severable. No provision shall be affected by the invalidity or unenforceability of any other provision, with the remaining provisions (if necessary) being amended as required to give effect to the spirit of these Terms and Conditions so far as possible.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. Should a dispute arise between me (or on my behalf) and the Organisers, I agree that the matter shall first be referred to mediation before any court proceedings are commenced.
10. Specific Event Rules and Requirements
- Each participant is required to wear an appropriate wetsuit during the swim leg. Participants may wear short wetsuits; however, all wetsuits should be no more than 5 mm thickness so that swimming movement is not impaired.
- Hard-shell helmets must be worn during the cycle leg.
- It is the responsibility of each participant to ensure that bicycles are in safe working order.
- Participants must be 18 years of age on race day to enter the TA-100 or Olympic races. Junior participants (aged 16–19 on race day) may enter the TRY or Sprint races only. Junior participants must be members of Triathlon Ireland and have the requisite parental or guardian consents in order to participate.
11. Acceptance – Adults and Minors
For adult participants (18 years and over on race day):
By checking the acceptance box / clicking "I Accept and Submit Entry" (or signing below), I confirm that I have read, understood and voluntarily agree to these entire Terms and Conditions of Entry and Participant Waiver (Version 2027.1), including the Assumption of Risk, Release, Waiver of Liability, Medical Consent, Image Rights and all other provisions. I understand that this is a legally binding contract and that I am giving up substantial legal rights.
For participants under 18 years of age on race day (juniors in the TRY or Sprint races only):
I, the undersigned parent or legal guardian of the minor participant named in this entry, confirm that: I have read and explained these Terms and Conditions (including the Waiver, Assumption of Risk, Release of Liability and Medical Consent) to the minor to the extent appropriate for their age and understanding; I consent to the minor's participation in the Event; I accept these Terms and Conditions on behalf of the minor and agree to be bound by them (including the release, waiver, indemnity and medical consent provisions to the extent they apply to me as guardian); the minor meets the age, Triathlon Ireland membership and other requirements stated herein; and I have the requisite parental consents and authority to enter into this agreement on the minor's behalf.
